While many states in the US are shutting out daily fantasy sports operators, there are a handful that are creating legislation to regulate the industry. One such state is Missouri, as lawmakers have been working to advance legislation that will give the state policies in place to allow such DFS competitions as provided by DraftKings and FanDuel.
The Missiouri House has passed a measure just last week that would require operators of daily fantasy sports sites to pay $5,000 in annual fees plus ban employees who have insider information of contests from taking part. Games would also be limited to individuals who are 18 years of age or older.
The new measure would exempt daily fantasy sports operations from the gambling laws of the state, which the opponents of the measure have stated is unfair. The issue, as it remains in each state discussing DFS, is if the contests consist of luck or are skill based.
Scott Fitzpatrick, a Representative of the state, and sponsor of the measure, questions the arguments of lawmakers who state that daily fantasy sports are considered gambling. In a statement, Fitzpatrick said that it is hard to say out of one side of your mouth that something is considered gambling and then say out of the other side it is unfair because the same people win most of the time, as to him it looks like DFS has a lot of skill involved.
A bill is also waiting to be debated in the State Senate which would place taxes as well as heavier restrictions on daily fantasy sports. In the State of the State Address, Governor Jay Nixon, called for legislators to address the DFS industry, stating that the House bill does address some of his concerns such as children are taking part and that the industry is unregulated but he also would like to see operators taxed for offering their services, stating the revenues could be used for education purposes.
