In the state of Oregon, there are several poker rooms in operation, with the majority located in the Portland area. These poker rooms could be facing a complete shutdown if a bill recently passed by the House of Representatives continues to move forward.
According to The Albany Democrat Herald, the House of Representatives voted in favor of HB 2190, a bill that was introduced back in January involving social poker gaming. The bill would allow counties and cities the right to authorize social poker games but only if these games are operated as well as controlled by an organization that is considered religious, fraternal or charitable. Basically, this would shut down for-profit poker rooms within the state.
A social gaming exemption has existed within the state of Oregon due to the constitution prohibiting nontribal casino gambling. The dealers of these poker games are not employees and are only paid in tips, helping the card rooms circumvent the law. Often times, the poker rooms have a cover charge instead of a rake charge plus they earn money by offering beverages and food items.
In the past, the office of the Attorney General for the state said that dealers of the poker games cannot earn a wage, which led to dealers being paid in tips. Poker was left alone for some time until the state Department of Labor decided that the dealers are employees and are not volunteers. Because of this, the city of Portland would begin enforcing old state codes.
The Black Diamond Card Room is one example of a poker offering in the state, owned by Greg Sapaugh. At this establishment, players pay a $7 cover fee and must be at least 18 years of age to take part in tournaments or cash gaming. The house does not get a cut of the winnings or earn a profit from losses while the poker chips stay between the players at the tables. Speaking with the Albany Democrat Herald, Sapaugh said that his card room is safe and fair, and not a shady poker room that is stereotypical of Hollywood movies. He even stops his customers from speaking foul language.
The card room owner has stated that he is not opposed to the regulation of card rooms in the state but wants to be allowed to operate and provide a service.
The bill now heads to the Senate for consideration.
