Borgata Seeking Same Ruling as England High Court in Phil Ivey Case

In the United States, the Borgata Casino is now hoping for a similar outcome and are now petitioning to see the very same ruling in the US.

A report at NorthJersey.com states that the attorneys for the Borgata Casino have filed a petition with the United States District Court which asks for the same ruling of the High Court to be applied to their case against Phil Ivey. It was just last week that the court in England rules that Ivey cheated to earn the $12 million while playing the baccarat variant and this past Monday, the attorneys for the casino filed a brief that would share the ruling with US officials. The casino is asking the judge in their case to reinforce their claim that using edge sorting is a form of cheating.

The Borgata claims that their case is basically the same as the one in England. In the overseas case, Ivey was suing the casino for the funds owed and ended up losing as the judge ruled he cheated by taking advantage of a flaw found in the playing cards. Ivey is the defendant in the Borgata case and is the one being sued in this instance. The casino is claiming $9.6 million in winnings that Ivey took from the casino over several sessions of the game back in 2012.

It has been reported that before these gaming sessions, Ivey had his associates request, several times, for the same type of gaming cards that were known to have the imperfections that he could spot. The demands by Ivey were seen as ‘superstitious’ at the time, which is what the poker star reportedly claimed.

The attorneys have stated they believe the English ruling should carry over in this instance as the same case has basically be litigated already. In the industry, poker players continue to side with Ivey in this case. Players either believe that if Ivey lost he would have had to pay, but he simply took advantage to win. While others believe that the casino is liable to ensure that the advantages are not there to be used to the player benefit.
