In 2021, Hermie Sadler took to a lower court in Virginia to stop the state from illegalizing skill games. Sadler is a former NASCAR driver. He now owns a truck stop.
The former NASCAR driver said banning the skill machines was against his First Amendment rights as a business owner. Sadler was lucky because the judge at Greensville County, Louis Lerner, issued an injunction, allowing skills games to continue running while the suit proceeded.
Virginia banned skills machines in 2020. However, following the economic effects of COVID-19, Governor Ralph Northam did not implement the ban, giving business owners time to recover. Meanwhile, Sadler’s lawsuit has been in the justice system, awaiting a decision on the skill game machines.
Sadler can now move on or keep fighting. This is due to the Supreme Court overturning the lower court’s decision. Consisting of three judges, the Supreme Court took an unusual move and ruled out Sadler’s lawsuit.
The court explained that Sadler’s lawsuit was unlikely to succeed because the General Assembly had already redefined skill games earlier. This means the ban on skills game machines is back on.
Meanwhile, the Supreme Court decision will not affect the ongoing lawsuit. In fact, the trial is scheduled for this December.
Confusion Surrounding Skill Games
Skill game machines are a lot more like slot machines. The difference is that the skill game manufacturers add an element of skill to the game to distinguish it from slot machines.
For instance, in Virginia, skill game machines require players to pick their winning lines. Meanwhile, slot machine winnings are automated and are based on luck.

Pennsylvania and Kentucky Still Struggling with the Topic
Many states are struggling with the issue of skill game machines. For instance, Bubba Technology Group, LLC in South Carolina, pleaded guilty to operating fish machines. These are considered skill games because they have the element of skills.
Kentucky also banned skill games from July 1, 2023. However, one of the skill game machine manufacturers, Pace-O-Matic (POM), sued the state, stating the Kentucky bill was unconstitutional.
POM also brought a similar lawsuit to Pennsylvania and won. The state had seized its machines, but the judge ruled they were skill game machines, which are legal in Pennsylvania.
