Lucky Lincoln Gaming operations are at stake of late as the Illinois Gaming Board (IGB) filed its third complaint against the video gaming terminal (VGT) operator accusing it of contravening the Video Gaming Act. Marcus Fruchter, the IGB’s Administrator, filed the latest complaint on May 12. It increases the complaints that the company is facing to 21.
Even so, the IGT filed other disciplinary complaints against Lucky Lincoln in 2017 and 2019. Its file complaint stated that Jeff Rehberger Jr., Lucky Lincoln Gaming’s owner, wanted to pay the full construction costs for two video gaming applicants and influence them to sign user agreements with his company.
The IGB accused Rehberger in its 2019 complaint of intending to alter witness testimony and prevent it from performing its roles in the defense that the respondent made against the board in 2017. Even so, the two complaints are awaiting administrative hearings now.
The gaming board claims in its recent complaints that the gaming operator contravened the Video Gaming Act’s Section 25(c), which bans a terminal operator from offering an establishment any valuable item as an inducement or incentive to install VGTs in its premises. Board Rule 25o(I) bans a licensed terminal company from offering such an inducement or incentive.
What Is Lucky Lincoln Gaming’s Defense?
The IGB’s latest disciplinary complaint adds that Pat Ostry, one of Lucky Lincoln’s workers, learned on or before July 2020 that My Way Café had shown its desire to get a VGT license despite operating and owning a Willow Springs license. The employee met with Teki Salievski, the café’s owner, to deliberate on how they can get a gaming permit and form a user agreement with his company.
Even so, the gaming board claims that Salievski informed Ostry that he didn’t want to change the café’s dining space for VGTs. But, Ostry stated that the gaming operator can provide the café with an adjoining structure and foot VGTs’ construction expenses.
The café chose Lucky Lincoln as its terminal operator when it sought a gaming license from the IGB. Yet, the board is accusing Rehberger of approving his company’s payment to a contractor to start renovating My Way Café. The investor signed a $21,790 check to the contractor.
Fruchter sought a limited summary suspension for the terminal operator in his May 2023 complaint to prevent it from getting a user agreement from another gaming operator or entering an agreement reached after May 12.
Lucky Lincoln filed a temporary restraining order on May 23 in Cook County Circuit Court against its suspension, which the court approved on June 2.
The court’s website shows that the IGB responded to the terminal operator’s order on June 30, and the issue’s next hearing will be on September 20. Jeff Heimerdinger, Lucky Lincoln’s President, stated the board’s decision to showcase its disciplinary complaint on its website is harming the operator’s employees and operations.
