Earlier this year, it was revealed that the United States Supreme Court would be hearing arguments in regards to whether or not the state of New Jersey should be allowed to legalize sports betting. Standing in the way is the Professional and Amateur Sports Protection Act, a federal law that bans the activity across the United States except for four states that were grandfathered in. It has now been announced that the Supreme Court will begin hearing arguments in the case involving NJ this December.
According to Northjersey.com, the Supreme Court will begin to listen to arguments in the case on December 4th. The case will be a test as to if the Constitution allows Congress to ban something in some states that is legal to do in other states. When the PASPA was created, Congress decided to ban sports betting across the board, except in states that did not legalize the activity before 1993.
The PASPA grandfathered in Nevada, with Montana, Oregon and Delaware offered the option to provide limited sports betting. Delaware allows parlay betting while Nevada is the only state to have full sports betting capabilities.
If New Jersey is successful in their plight, the racetracks of the state and casinos in Atlantic City would be able to begin to offer sports betting on both professional and amateur events. Back in June, the US Supreme Court decided they would hear the case and now, sports bettors have been anxiously awaiting to see when the case would move forward.
If the Supreme Court rules that the PASPA is unconstitutional, then any state within the US would have the ability to legalize sports betting. In 2012, voters in New Jersey decided they wanted to legalized sports betting. However, the state was sued soon after the vote as sports leagues did not want to see sports betting take place in the state.
