So far in 2017, three states have formally created legislation that was passed into law, legalizing and regulating daily fantasy sports within their borders. Taking the third spot for 2017 is the state of New Hampshire. Governor Chris Sununu signed H 580 just recently after state legislature passed the bill last month.
The law includes language that sets the New Hampshire Lottery Commission as the regulator of the industry and they will be able to create rules for overseeing contests. Operators who register with the state will not have to pay a tax or fee. This is quite a different tactic from other states and a previous version of the measure had a fee in place as well as revenue tax.
Operators have to apply for registration in order to provide services but any already in operation may continue to offer services as the law takes effect. Basic consumer protections are set within the law for users who take part in DFS contests on registered sites. This will include employees being banned from game play, player funds must remain segregated from operational funds as well as responsible gaming protocols put into place. Participants must be 18 years of age or older to compete.
The total number of states that have legalized daily fantasy sports now reaches 13 with other states also looking to pass legislation. States that have signed DFS bills into law include:
- Arkansas
- Tennessee
- Colorado
- Virginia
- Indiana
- Vermont
- Kansas
- New York
- Maryland
- New Hampshire
- Massachusetts
- Missouri
- Mississippi
Several other states are showing promise to pass legislation involving daily fantasy sports in the future. This would include Maine and New Jersey. Pennsylvania is very close to passing legislation as they have included DFS in a gaming package as part of a major expansion within their gaming industry. It will be interesting to watch to see which other states pass legislation in the coming months and join the list of states that have formally accept DFS gaming.
