Gambling laws continue to fluctuate in the United States as more states have either passed online gaming legislation have petitioned bills to outright ban intrastate online gambling. One more state could now be heading in the latter direction if a new deal is struck.
New Mexico and its Navajo tribes are currently discussing the creation of a new tribal compact which could ban online gambling in the state.
The Albuquerque Journal reported that a new deal is currently under negotiation with the state and the Navajo Nation. Any form of online gambling would be banned and the tribe would be able to keep slots revenues in the state if officials choose to allow internet gaming options.
The Navajo tribe would then have to begin ‘good faith negotiations’ as well as arbitration if it is deemed appropriate. This would mean that revenue sharing would be discussed with state officials to determine how online gambling would impact brick and mortar casinos located there.
A statement was made in the report on this subject by Enrique Knell, a representative of Governor Susana Martinez, which read:
“This provision was intended to discourage the adoption of internet gaming in the state, while ensuring that, if internet gaming is adopted, revenue sharing continues in light of any new benefit/detriment to the (Navajo) Nation.”
The new deal names certain casino games in the language, including the game of poker. The new compact also states that New Mexico is not allowed to have any online gambling deals with other states that offer the gambling option. The compact also states that if the Navajo Nation decides they want to provide online poker options, the tribe would not have to give any online gaming revenues to the state of New Mexico.
The compact has now been sent for approval and legislators only have a few more days to decide if they’ll go forward or not. If the deal is approved, it could set possible precedents to other states with similar tribal casinos.
