New DFS Bill Introduced in Florida

Daily fantasy sports is a subject that many states in the US have been looking in to over the past year. For 2017, the state of Florida will be the latest to consider daily fantasy sports legislation after a bill was introduced by State Representative Jason Brodeur on the subject. The bill is being used to clarify the legality of daily fantasy sports but will not regulate the industry in the state. The bill, known as H 149, is only two pages long and defines the term fantasy contest and fantasy contest operator similarly to how the terms are defined in the UIGEA as well as several state laws.

The new bill states that contests as well as operators are not subject to regulation. Both are also exempt from parts of state code, mostly in regards to games of skill and gambling. Speaking to Florida Politics, Brodeur stated that with the bill, he wants to clarify whether daily fantasy sports in the state are legal. Brodeur commented that the question was never answered and that millions of Floridians who play the games deserve to know that what they are taking part in is not a crime.

In regards to the legality of daily fantasy sports, the process was first started by Senator Joe Negron along with Representative Matt Gaetz towards the end of 2015 in the state. However, their efforts did not move forward. In 2016, legislation was introduced to regulate the industry, but also did not move forward. For this year, it is not clear as to why the efforts do not include a component for regulation, since the past attempts did.

Florida is one of several states that has seen legislation introduced that involves daily fantasy sports. These states actually introduced legislation last year but the measures did not become law. Eight states were able to pass legislation in regards to daily fantasy sports in 2016.
