Attorney General Nominee Loretta Lynch Weighs In On iGaming

DE gamblingAfter being questioned weeks ago by Senator Lindsey Graham on her stance of web gambling, Attorney General Nominee Loretta Lynch has now come forward with her thoughts on the subject. Lynch has stated it is not likely that she will be reversing the decision by the Department of Justice to change the Wire Act to allow legalized online gambling within the United States.

According to a report by the ReviewJournal, Lynch will be reviewing the memo from 2011 of the department’s Office of Legal Counsel if she is confirmed but would most likely not be changing the reinterpretation. This memo reinterpreted the language of the Interstate Wire Act of 1961, which restricts the transmission of wagering information. According to Lynch, it is her understanding that OLC opinions are rarely reconsidered.

Lynch stated that unless in the course of her review she concludes that the OLC’s interpretation of the Wire Act is unreasonable, she does not intend to take any action to revoke or suspend the opinion. Lynch is currently the United States attorney for the Eastern District of New York and was recently questioned of her thoughts of online gambling and many other subjects during her Senate confirmation hearing back in late January.

Graham was at the forefront of the questioning of online gambling trying to see if Lynch would be on the same page as himself and others who are not in favor of online gambling. Senator Dianne Feinstein was also in attendance and asked Lynch of her views since she also believes that a case could be made to make all online gambling options illegal.

After the hearing, Lynch answered follow-up questions and defended the Office of Legal Counsel stating that because the OLC helps the president fulfil his constitutional obligation to take care that the law be faithfully executed, it is her understanding that the Office strives to provide an object assessment of the law using traditional tools of statutory interpretation. Lynch further stated that she would be happy to work with Graham and other members of Congress to address any concerns of online gambling through legislation.
