Boss Media Defends Aftermath Of Poker Trillion Court Ruling
August 20, 2008
It was revealed yesterday that Poker Trillion has won its case in a civil court in Malta against online poker network giant, Boss Media. Operator if the International Poker Network (IPN), Boss Media, refuted the claims made by Poker Trillion yesterday that the court ruling “…will in effect bring down Boss Media’s operation…”
The statement from Poker Trillion went on to say that “…any partner still on the Boss (IPN) Poker Network at this stage will see their service closed down, too.”
Boss Media immediately defended their position by releasing their own statement, reassuring the players on its poker network that their funds are segregated, and will not be affected in any way by the current legal situation. The statement from Boss Media called Poker Trillion’s comments “…a reckless attempt to support a legal action that is without merit and [was] initiated as retribution for their dismissal from the Boss Media network.”
Boss Media further clarified its assertion, “…player funds are not affected by the current proceedings. All players’ funds are held separately under the control of the Malta Lotteries and Gaming Authority and cannot be seized by any court.”
The online poker network then advised its license holders and players of the past dealings with Poker Trillion, reminding them that the online poker room was once a licensor of IPN whose contract was terminated due to alleged violations of a rake back program.
Boss Media claims that Poker Trillion has “…since then repeatedly tried to disrupt the Boss Media business through the dissemination of groundless rumours. In April 2008, PokerTrillion alleged in a press release a claim that among other things, Boss Media player funds were frozen. The allegations were false but typical of the type of tactics employed by PokerTrillion.”
According the Boss Media, only preliminary hearings have been held on the actual merits of the case, not the full judicial proceedings, but that the online poker network has plenty of requisite assets primed to continue normal business operations in the event of an unsavory outcome.
“Boss Media has assured that adequate security is provided in Malta in the event of an award of damages against it which we believe be to unlikely,” the statement persist. “In the extremely unlikely event that any Malta operations would be affected, Boss Media has high-performance back-up systems in place to ensure continued service to all our customers and their players.”
Court Rules Boss Media To Be Seized By Poker Trillion
August 19, 2008
Judge Gino Camilleri of the First Hall Civil Court in Malta issued a ruling yesterday, August 18, that authorized online poker room POKERTRILLION.com to seize full control of Boss Media Limited Malta and Boss Media AB Servers, which includes the Boss Poker Network (IPN).
According to the ruling, Boss Media servers must cease all commercial enterprises no later than September 18, 2008; exactly one month after the ruling was handed down. Boss Media was denied the option to appeal the court’s decision.
Back in April, a judge called for the freezing of all Boss Media assets as Poker Trillion had declared a €45million lawsuit against the Boss Poker Network and online payment processor, WebDollar. Poker Trillion stated then that the lawsuit was “for alleged fraudulent and potential criminal activities of various personnel and/or the management of Boss Media, or their associated companies in various jurisdictions including but not restricted to, Sweden and Malta.”
The judgment announced yesterday is just one in a string of successful applications made by Trillion Ltd. in the Malta courts. It was also ordered that cosignatory, now responsible for all Boss Media equipment, must record and present full accounts of revenue derived from the equipment.
“Today’s decision will in effect bring down Boss Media’s operation in their licensed jurisdiction of Malta on September 18, and any partner still on the Boss (IPN) Poker Network at this stage will see their service closed down too”, clarified Andy Pyrah, CEO of POKERTRILLION.
“It should also be noted that despite appeals from Boss Media,” Pyrah continued, “we’ve been successful in every one of our applications that we’ve filed with the courts in Malta and this includes having our initial garnishee order increased from €5million to €20million earlier this month, this in turn means that there is now a €20million freezing order on all Boss Media’s assets within this jurisdiction, and in accordance with European law we will be applying for this to be executed all over Europe”.
Boss Media and the Boss Poker Network (IPN) currently has about 100 online gambling sites licensing its software and utilizing the network’s expansive shared player base. Among the many online poker rooms that will be affected by the ruling are: 24hPoker, Virgin Poker and Paradise Poker, as well as SportingBet.com and William Hill Casino.
