Earlier this week, the United States Supreme Court decided to grant a petition by the state of New Jersey to hear their sports betting case. New Jersey has been trying for several years now to legalize sports betting within their borders and the highest court of the land has now agreed to hear the appeal. The Supreme Court rarely agrees to hear appeals so it was a move by the court that was unexpected.
With the appeal, additional briefs will be filed and oral arguments heard by the nine justices of the Supreme Court. The state will have to work hard to be able to convince the majority to side against the Professional and Amateur Sports Protection Act of 1992 and allow the state to move forward with legalization of sports betting.
It is believed that the case will not see a resolution until next year. The state has already passed laws two times in an attempt to see sports betting legalized in the state. However, these efforts have failed due to federal court rulings. The latest setback took place when the United States Third Circuit Court of Appeals decided to rule against the effort by New Jersey back in August of last year.
The appeal within the US Supreme Court was boosted when the United States Solicitor General was asked to give an opinion on the matter but the office of the Solicitor General eventually decided that the appeal should not be heard.
The state has been fighting the PASPA for some time now, which prohibits states from offering single-game wagering. Within the sports betting case, professional sports leagues such as the NHL, NFL and NBA have used the legislation in order to keep the state from changing its laws to allow sports betting to take place.
So now it’s just a waiting game as the state prepares for the Supreme Court to hear their case. The case basically starts again and will be advancing from the cert stage to the merits stage. New court filings will take place including a full briefing on the merits as well as oral arguments.
