An executive order was issued late last week by Nevada Governor Brian Sandoval to see the Gaming Policy Committee reconvene to discuss daily fantasy sports within the state. The action by Sandoval was in response to the ruling by the state’s Attorney General Adam Laxalt last fall that the DFS market of the state is considered gambling online and is not to be allowed unless licensing is obtained.
The state currently only offering licensing for online poker gaming via the Gaming Commission. Until the ruling by Laxalt, the daily fantasy sports industry of Nevada was considered a game of skill and not an activity that operators needed to be licensed to offer residents of the state.
Sandoval’s office released a statement in regards to the reconvening of the committee, stating that the meeting of the Gaming Policy Committee will concentrate on the status of the state’s interactive gaming agreement, daily fantasy sports, skill-based games, innovative gaming devices and other topics. The meeting does not have a date set as of yet.
In a press release, Sandoval stated that he is reconvening the Gaming Policy committee to bring the leaders of the state together to address the recent challenges and opportunities in the gaming industry. Sandoval further stated that he looks forward to continuing to set the pace and standards for global gaming from Nevada.
As part of the decision by Laxalt in regards to daily fantasy sports, the market leaders DraftKings and FanDuel were sent cease and desist letters. Both companies quickly stopped offering their services within the state.
While the decision by Laxalt is not in favor of DFS sites, Sandoval’s decision to start the conversation on the subject is. Most of the Gaming Policy Committee are in favor of gambling, so it could be the meeting resolves any issues and allows a way for the daily fantasy sports sites to offer their services within the state. The last time the committee met was in the summer of 2012, so it has been some time since such discussion in regards to gaming topics have been had.
