The National Conference of State Legislatures is an organization that works to help states to improve the quality and effectiveness of legislation in the US. Back in April, the group contacted leaders of the Senate and House in letter form to show their opposition of an extension of the Wire Act. According to Pokerfuse, the group has now decided to take an official position on the subject to demand that online gambling legislation options stay on a state level.
The NCSL would like the government (federal) to respect the ‘sovereignty of states’ to make the choice of allowing or prohibiting online gambling for citizens within each state. A meeting took place on August 22nd with the National Conference of State Legislatures members and during the meeting a vote occurred on the subject. The group was in favor by over 2/3 of the members of state regulation.
The new policy of the NCSL is now being sent to politicians and is stating the opposition for any attempt of a reversal when it comes to the Wire Act as it was reinterpreted by the Department of Justice. With the reinterpretation, the states have the option to pass legislation to approve online gambling if they so choose. Currently, there are bills in both the Senate and the House that would reserve the ruling and change the Wire Act so that states do not have this option.
The NCSL stated: “Any effort by Congress or the administration to reverse this ruling is preemptive and diminishes the flexibility of state legislatures to be innovative and responsive to the unique needs of the residents of each state.”
The bills in the house are titled Restoration of America’s Wire Act and area backed by Sheldon Adelson, a huge opponent of online gaming. Adelson has unlimited funds at his disposal to try and push this change, even creating the Coalition to Stop Internet Gambling. However, the efforts of Adelson have been opposed by several states as most want to keep the decision to offer online poker or casino gaming on a state level.
