New York State was the first to take action on daily fantasy sports operators such as DraftKings and FanDuel, when the Attorney General of the state, Eric Schneiderman, decided to declare DFS as gambling and sent out a cease and desist orders to the companies. Now, the two companies have reached an agreement with New York and will no longer offer their services within the state.
Back in November, the DFS companies were told their activities were in violation of the state gambling laws. Both FanDuel and DraftKings fought the decision and have continued to do so over the past few months. On Monday, it was announced that each company would be ceasing operations in New York as the state continues to work on a bill that would allow DFS contests to take place legally.
Schneiderman released a statement on the agreement, commenting that he is pleased to announce that DraftKings and FanDuel will no longer be taking bets in the state, begin consistent with the cease-and-desist orders that were issued by his office at the beginning of the matter. With the agreement, it creates an expedited path that will resolve the litigation should the law change or a decision is reached by the appellate division, according to the attorney general.
Legislation is now being considered that would regulate the DFS industry within the state. The bill is an addition to another bill that would see online gaming take place in peer-to-peer poker game play. The DFS legislation seems to be moving ahead quickly while the online poker bill will most likely take a little longer. It is believed that iPoker will have to wait until the land based casinos are built within the state.
Both DraftKings and FanDuel have released a statement on the matter, citing that they are grateful to their players of New York who have enjoyed the DFS contests. Both will continue to work with lawmakers to see legislation enacted in regards to fantasy sports so New Yorkers can be back to enjoying the contests as quickly as possible.
