5 Years or Less for Taj Majal Killing over Poker Game.
May 31, 2008
A fight broke out at the Taj Majal Casino in Atlantic City, following a disagreement at one of the casinos poker tables. Vincente Perez accused in the stabbing death of his fellow poker player, Arthur Prince, 61, of Toms River that he didn't mean to kill his opponent. Perez, a self employed truck driver explained to the judge that he was acting only out of self defense.
The two men stepped out of the casino and entered the valet parking area of a casino parking garage. They argued, and soon became violent. According to news reports, the Perez told said Prince beat him in the face with a cane, several times. In 'Self Defence' Perez stabbed the other man in the back, neck and cheek.
In a plea deal the charge against Perez was dropped from Aggravated manslaughter to reckless manslaughter, a second degree crime. Additional charges including the unlawful possession of a weapon, and possession of a weapon for an unlawful purpose will be dropped as per the agreement.
"(Perez) had an honest, but unreasonable belief that the use of deadly force was necessary to defend himself when Prince was assaulting him with a cane," Talasnik said. "And such conduct is described in our case law as imperfect self-defense, a form of reckless manslaughter." - pressofatlanticcity.com
