In the state of New York, the summer months resulted in a law being enacted that legalized and regulated daily fantasy sports. Legislature of the state along with Governor Andrew Cuomo approved the legislation, a move that is now being challenged by residents according to Stop Predatory Gambling.
The group, Stop Predatory Gambling, issued a press release today that states a group of citizens from New York filed a lawsuit today within the New York State Supreme Court. The suit argues that the law involving daily fantasy sports needed a constitutional amendment to be legally binding.
The state constitution authorizes other gambling in the state and the lawsuit argues that daily fantasy sports must also be authorized in this manner. Proponents of the DFS law as well as the overall industry state that the activity is one of skill so it is not considered gambling.
The press release by Stop Predatory Gambling includes a statement by Neil Murray, an attorney with O’Connell and Aronowitz, the group that filed the lawsuit, which reads that the plaintiffs seek to protect the public from predatory gambling consistent with the Constitution. The plaintiffs also want to stop such online gambling operators as DraftKings and FanDuel from exploiting the financially desperate and those addicted in the state.
The press release also pointed out that Attorney General for the state, Eric Schneiderman has already been on record stating that DFS gambling is in violation of the constitution and many citizens of the state share his concern. Schneiderman originally had an opinion that DFS gaming was illegal, leaving FanDuel and DraftKings shut out of operation in the state after months of trying to reach a settlement.
Now it seems the legality of DFS is going to be challenged once again in the state. Daily fantasy sports proponents will now have to wait and see if the lawsuit moves forward and if the industry will be threatened once again in New York.
